Terms of Service

KALAKAR is a creator marketing platform operated by Kalakar Agency SMC Pvt Ltd, a single-member private limited company incorporated in Pakistan and based in Islamabad.

In these terms, “KALAKAR”, “we”, “us” and “our” mean Kalakar Agency SMC Pvt Ltd. “You” means anyone who uses kalakar.agency or any service we provide through it. “Creator” means a person who applies to or joins our creator network. “Business” means a company or person who submits a campaign brief or engages us for services.

By using the site, submitting a form, or creating an account, you agree to these terms. If you do not agree, please do not use the site.

If you accept these terms on behalf of a company, you confirm you are authorised to bind that company.

We connect brands with creators. We maintain a network of reviewed creators, plan campaigns for businesses, coordinate content, and report on results.

Much of this is done manually by our team today. The site is primarily a way to discover creators, submit a brief, and apply to the network — it is not an automated marketplace, and submitting anything through it does not by itself create a campaign, a booking, or a contract.

You must be at least 18 years old to apply as a creator, submit a brief, or hold an account. The site is not intended for children.

Applying to the network does not guarantee acceptance. Every application is reviewed by a person, and we may approve, reject, or ask for more information at our discretion.

• Everything you submit — handles, follower counts, views, engagement, city, rates — must be accurate and about accounts you actually control. Inflated, purchased, or fabricated metrics are grounds for immediate removal.
• You are responsible for keeping your login credentials secure and for activity under your account. Tell us straight away if you think it has been compromised.
• Approved profiles are published on the public creator directory and may be indexed by search engines. What we publish is described in our Privacy Policy.
• Being in the network does not guarantee campaigns, invitations, income, or any minimum level of work. We make no promise of earnings.
• You may ask us to remove your profile at any time by emailing hello@kalakar.agency.

Submitting a brief through /campaign is a request, not an order. It creates no obligation on either side until we agree scope, fees, timelines, and deliverables in a separate written proposal or agreement.

Where that written agreement conflicts with these terms, the written agreement governs the engagement it covers.

Any figures shown on this site relating to fees, budgets, reach, or results are illustrative unless we have confirmed them to you in writing for your campaign.

You keep ownership of everything you submit — your profile information, images, videos, briefs, and campaign materials.

By submitting content to us, you grant KALAKAR a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating the platform, reviewing your application, presenting you to prospective clients or creators, and promoting KALAKAR and its campaigns. You can end this licence for future use by asking us to remove the content.

You confirm you own the content or have the rights to grant this licence, including rights to any music, footage, trademarks, and to the likeness of anyone appearing in it.

Content published on Instagram, TikTok, YouTube, or Facebook and shown here through official embeds remains subject to that platform’s own terms.

You agree not to:

• Submit false, misleading, or someone else’s information, including fabricated performance metrics.
• Scrape, crawl, or bulk-extract creator data from the site, or use it to build a competing database.
• Contact creators listed here for spam, harassment, or anything unlawful.
• Upload malware, attempt to break authentication, probe our infrastructure, or interfere with the site’s operation.
• Post content that is unlawful, defamatory, hateful, obscene, or that infringes anyone’s rights.
• Use KALAKAR’s name, logo, or brand without our written permission.

The KALAKAR name, logo, design, copy, and the software behind this site belong to Kalakar Agency SMC Pvt Ltd and are protected by intellectual property law. Nothing in these terms transfers any of it to you.

The site links to and embeds content from third-party platforms. We don’t control those services and aren’t responsible for their content, availability, or practices. Metrics sourced from them can change or be inaccurate.

Using the site is free. Fees for campaigns and services are set out in the written agreement for that engagement, along with payment terms and currency.

Amounts are exclusive of applicable taxes and duties unless stated otherwise. Each party is responsible for its own taxes, and payments may be subject to withholding tax as required by Pakistani law.

The site and the network are provided “as is” and “as available”. We don’t promise the site will be uninterrupted or error-free.

We do not guarantee any campaign outcome — no level of views, reach, engagement, sales, or that anything will go viral. Social platforms control distribution, and results vary. Creator metrics shown here are largely self-reported or drawn from public platform data, and we present them as supplied.

To the fullest extent permitted by law, KALAKAR is not liable for indirect, incidental, special, or consequential loss, or for lost profits, lost revenue, lost data, or loss of goodwill.

Our total liability arising out of or relating to the site or a service is limited to the amount you paid us in the three months before the event giving rise to the claim, or PKR 25,000 if you have paid us nothing.

Nothing here limits liability that cannot be limited under applicable law, including for fraud.

You agree to indemnify KALAKAR against claims, damages, and reasonable costs arising from content you submit, your breach of these terms, or your violation of anyone’s rights or of applicable law.

We may suspend or remove an account, profile, or content — with notice where reasonable, and without notice where the situation calls for it — if these terms are breached or if we’re required to.

You may stop using the site at any time and ask us to close your account. Sections covering content licence for material already published, intellectual property, disclaimers, liability, indemnity, and governing law survive termination.

We may change the site or these terms. When we do, we update the date at the top of this page, and material changes will be flagged on the site or by email where we hold your address. Continuing to use the site after a change means you accept the updated terms.

These terms are governed by the laws of Pakistan. The courts at Islamabad have exclusive jurisdiction over any dispute, though we’d rather you email us first and give us a chance to sort it out.
